Please read these terms carefully before installing or using SmallBizzCMS.

Grant of License
TheHobbyist ("Developer") grants you a personal, non-exclusive, non-transferable, revocable license to install and use SmallBizzCMS ("the Application") on devices that you own or control, solely for your personal or internal business purposes.
You may not sell, sublicense, redistribute, reverse-engineer, decompile, or create derivative works from the Application without the Developer's prior written consent.
Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THE DEVELOPER DOES NOT WARRANT THAT THE APPLICATION WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APPLICATION IS SOLELY AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, THEIR AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY:
— Indirect, incidental, special, consequential, or punitive damages;
— Loss of profits, revenue, data, business goodwill, or anticipated savings;
— Damages arising from loss, corruption, or inaccessibility of your data;
— Damages arising from your use of or inability to use the Application;
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $10.00.
Data and Backup Responsibility
SmallBizzCMS stores all data locally on your device. The Developer assumes no responsibility for data loss resulting from hardware failure, accidental deletion, operating system corruption, malware, theft, or any other cause.
You are solely responsible for maintaining adequate backups of your data. The Developer strongly recommends regular backups to an external drive or encrypted cloud storage service of your choosing.
Indemnification
You agree to defend, indemnify, and hold harmless the Developer from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Application or your violation of these terms.
Governing Law
These terms shall be governed by and construed in accordance with applicable law. Any dispute arising from these terms or your use of the Application shall be subject to the exclusive jurisdiction of the competent courts in the Developer's jurisdiction of residence.
Changes to These Terms
The Developer reserves the right to modify these terms at any time. Updated terms will be posted on this page with a revised effective date. Continued use of the Application after changes are posted constitutes your acceptance of the revised terms.
If you do not agree with any changes, you must discontinue use of the Application and uninstall it from your devices.
Entire Agreement
These terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of SmallBizzCMS and supersede all prior agreements and understandings.
